    Any person, firm, company, government body or other entity who accesses or uses this website is referred to as “you” or “Customer”.

 

  1. Terms of Use
    – By you using this website you acknowledge and agree that you have read and understood these Terms of Use of the Company for the use of this website and that these Terms of Use apply exclusively to your accessing and using this website.

– By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

– You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

– A breach or violation of any of the Terms will result in an immediate termination of your Services.

By accessing or using the Site, you represent and warrant that you have not been previously suspended or removed from the Site, or engaged in any activity that could result in suspension or removal from the Site.

  1. Goods and Services

– All prices are shown in AUS dollars and applicable taxes and other charges, if any, are additional. We reserve the right to adjust prices as we may determine in our sole discretion, at any time and without notice. We will not, however, be able to notify you of changes in any applicable taxes.

– While we attempt to avoid errors in pricing and product information, some information (including prices) may be inaccurately displayed on the Site due to system or typographical errors. We reserve the right to correct any and all errors in pricing or product information when they occur, and we do not honour inaccurate or erroneous prices. If a Product’s listed price is lower than its actual price, we will, at our discretion, either contact you for instructions before shipping the product or cancel the order and notify you of such cancellation. If the order has been shipped, you agree to either return the Product (at your own expense) or pay the difference between the actual and charged prices.

– All of our Products and Services are subject to availability, and we reserve the right to impose quantity limits on any Order, to reject all or part of an Order, to discontinue offering certain Products and Services without prior notice.
– By you using this website you also acknowledge and agree you have read and understood the Terms and Conditions of Yarra Valley Printing on which goods and services are supplied by the purchaser as they appear on this website and that those Terms and Conditions will apply exclusively to the supply of all goods and/or services made by the account holder to you the pursuant to orders placed by you using this website.
– You also acknowledge and agree that the Terms and Conditions may be varied by Yarra Valley Printing from time to time by the Company amending the Terms and Conditions as they appear on this website or by notice in writing to you.
– By you using this website after the Terms and Conditions have been varied as aforesaid, you agree that the Terms of Conditions as so varied will apply exclusively to the supply of all goods and/or services

(a) these Terms of Use will prevail over this website and the Terms and Conditions; and
(b) the Terms and Conditions will prevail over this website.

 

  1. Taxes

– All items entering a foreign country are subject to customs inspection and assessment of duties and taxes in accordance with each country’s applicable laws. We reserve the right in our sole discretion to require you to pay for all duties and taxes incurred on any Products or Services you purchase, new or exchanged. Yarra Valley Printing cannot determine these fees during the checkout process. For more information, please contact your local customs office.

– In the event that you refuse delivery of the shipment, you are solely responsible for payment of all return shipping charges, duties and taxes; in this case, return shipping charges, duties, and taxes will be billed to you in accordance with the method of payment you selected in the checkout process.

  1. Log-in and Password
    – You agree that you are responsible for the safekeeping of your log-in and password.
    – You also acknowledge and agree that Yarra Valley Printing is not required to enquire as to the authenticity of orders for goods and services placed using the log-in and password issued to you, and that you are liable for all (authorised and unauthorised) orders placed using the log-in and password issued to you by you.
    – You agree to release and indemnify Yarra Valley Printing in connection with any use (whether authorised or unauthorised) of your log-in and password.
    – The Company may suspend or cancel your log-in and password at anytime without prior notice.
  2. Orders
    – Any order placed by you on Yarra Valley Printing for goods and services using this website is subject to acceptance by Yarra Valley Printing in accordance with the Terms and Conditions.
    Acknowledgement of receipt of an order placed by you on Yarra Valley Printing for goods and services using this website does not constitute acceptance by Wax Liquidizer Australia.
    – Yarra Valley Printing reserves the right to accept or reject an order placed by you on Yarra Valley Printing for goods and services using this website for any reason, including (without limitation) the unavailability of ordered goods or services, an error in the price, an error in the description of the goods or services or an error in your order.
    – Yarra Valley Printing will advise you if it is not able to accept any order placed by you on the website once Yarra Valley Printing has considered any such order.
    – You may not cancel or defer an order placed by you using this website without the prior written consent of the business even if the order has not yet been accepted by Yarra Valley Printing, and you should therefore very carefully review any order for goods and services proposed to be placed by you using this website before it is placed.

– Separate charges for shipping will be shown on the order page during checkout. You agree to pay any shipping charges shown at the time you make a purchase. Shipping is handled by a third party courier. Actual delivery dates may vary. You agree that you will not obtain, or direct shipment of, a Product for export. All Products purchased from us are made pursuant to a shipment contract. This means that title to and the risk of loss of such Products passes to you upon our delivery of the Product to the third party courier. See our shipping policy for further information.

– The order will be shipped once direct deposit payment has cleared.

– You are not permitted to resell or otherwise use the Products or Services for commercial purposes.

  1. Errors
    – You acknowledge and agree that despite reasonable precautions being taken, goods and services may be listed at an incorrect price or with incorrect information due to errors, corruption or like events.
    – In these circumstances, Yarra Valley Printing will be entitled to cancel the order or to adjust the price for goods and services ordered by you using this website to the correct price and information and you agree to pay Yarra Valley Printing corrected price.
  2. Payment
    – Payment for goods and services ordered using this website must be made in accordance with the Terms and Conditions.
    – You also acknowledge and agree that Yarra Valley Printing is not required to enquire as to the authenticity of orders for goods and services using the Customer’s Log-in and passwords.

 

  1. Return, Refund or Exchange of Goods

– You are responsible for inspecting all Products you receive from us for any damage or other issues upon delivery. If your order is damaged in shipping please contact Yarra Valley Printing upon receipt of order as per our shipping policy.
– You should very carefully review any order for goods and services proposed to be placed by you using this website before it is placed . Goods cannot be returned or exchanged once the order is confirmed by direct deposit payment.

 

  1. Cancelled Orders
    – In the event Yarra Valley Printing agrees to you cancelling or deferring an order placed by you using this website in accordance with Clause 6 of these Terms of Use, the Company may charge a fee for the cancellation of such order.

 

  1. Feedback and other Submissions

– If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, ‘comments’), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

– We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

– You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website.     The Customer agrees to indemnify and keep Yarra Valley Printing fully indemnified from and against any and all suits, actions, claims, demands, losses, liabilities, damages, costs and expenses which Yarra Valley Printing may suffer or incur arising in any way in connection with the Customer’s use of this website or a breach by the Customer of these Terms of Use.
  2. Disclaimer
    To the maximum extent permitted by law, any condition or warranty which would otherwise be implied into these Terms of Use is hereby excluded.
    To the maximum extent permitted by law and subject to the following paragraph of this Clause 15, the Customer agrees that the Company has no liability, and will not be liable, to the Customer or any other person whether in contract, tort or otherwise for any costs, expenses, injury, loss or damage of any kind (including, without limitation, direct, indirect, special or consequential loss or damage of any kind, loss or profits, loss or corruption of data, business interruption or indirect costs) the Customer or any other person may suffer or incur (whether by the negligence or fault of Yarra Valley Printing or otherwise, except where Yarra Valley Printing has purposefully acted in bad faith) arising in any way in connection with the use of this website by the Customer.
    If rights are conferred upon the Customer or obligations are imposed upon Yarra Valley Printing by certain Federal or State legislation which cannot be excluded, the provisions of this Clause 15 shall be read subject to those rights or obligations, and to the extent permitted by such legislation Yarra Valley Printing hereby expressly limits its liability under any such legislation to the maximum extent permitted by law.
    Subject to the preceding paragraph of this Clause 15, the Customer agrees that the liability of Yarra Valley Printing (which cannot be limited beyond the following provisions) is limited to:
    (a) in the case of the supply of goods by the Company, any 1 or more of the following (at the Company’s option):
    (i) the replacement of the goods or the supply of equivalent goods;
    (ii) the repair of the goods;
    (iii) the payment of the costs of replacing the goods or of acquiring equivalent goods; or
    (iv) the payment of the costs of having the goods repaired; or
    (b) in the case of the supply of services by the Company, any 1 or more of the following (at the Company’s option):
    (i) the supply of the services again; or
    (ii) the payment of the costs of having the services supplied again.
    Without reducing the effect of, and subject always to, the preceding provisions of this Clause 15, Yarra Valley Printing total aggregate liability (if any) to a Customer arising in any way in connection with the use of this website will not, in any event, exceed the amount invoiced by Yarra Valley Printing to the Customer in connection with the use of this website by the Customer pursuant to which any such liability of the Company to the Customer arises.
    For the sake of clarification, nothing in the preceding provisions of this Clause 15 is to be construed as Yarra Valley Printing having any actual or deemed liability to the Customer or any other person as a result of or in any way arising out of or in connection with the use of this website.
  3. Miscellaneous
    Nothing in these Terms of Use shall be read or applied so as to exclude, restrict or modify or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy implied by law (including, without limitation, the Trade Practices Act 1974) and which by law cannot be excluded, restricted or modified.
    Headings used in these Terms of Use are for convenience only and shall be ignored in construing these Terms of Use.
    “Terms and Conditions” means the terms and conditions of Yarra Valley Printing on which goods and services are supplied by Yarra Valley Printing as they appear on this website (or which have otherwise previously been agreed to by the Customer) as may be varied by Yarra Valley Printing from time to time by the Company amending the Terms and Conditions as they appear on this website or by notice in writing to you.
    The failure of Yarra Valley Printing to enforce or exercise at any time or for any period of time any term of any contract incorporating these Terms of Use shall not constitute or be construed as a waiver of such term and shall in no way affect Yarra Valley Printing’s right thereafter to enforce or exercise same.
    Any provision of these Terms of Use which is or becomes prohibited or unenforceable in any jurisdiction shall, as to such jurisdiction, be ineffective and severed to the extent thereof without invalidating any other provision of these Terms of Use, and any such prohibition or unenforceability shall not invalidate such provision in any other jurisdiction.
    These Terms of Use and any contract entered into between Yarra Valley Printing and the Customer shall be governed by and construed in accordance with the laws of the State of Victoria, Australia and the Customer hereby irrevocably and unconditionally submits to the non-exclusive jurisdiction of the Courts of the State of Victoria, Australia and of any Courts which may hear appeals there from; provided however that these Terms of Use may be enforced by Yarra Valley Printing against the Customer in any other jurisdiction.
